Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Carolina Preparedness ("we," "us," or "our") governing your use of carolinapreparedness.com and related subdomains (the "Site") and any class, event, or service we provide (collectively, "Services"). By using the Site or registering for a class, you agree to these Terms and to our Privacy Policy and Refund Policy.

2. Eligibility

You must be at least 18 to create an account, register for a class, or make a purchase. Parents or legal guardians may register minors for youth and family classes and must accompany them where required. Firearms courses have additional legal eligibility requirements (see Section 8).

3. Registrations and payment

• Registration is confirmed only after successful payment and receipt of a confirmation email.
• Prices, dates, times, locations, and instructors are subject to change; we will notify registrants of material changes.
• Payments are processed by Stripe. You authorize us to charge the payment method you provide.
• You are responsible for providing accurate registration information for each student.

4. Refunds, cancellations, transfers

Refunds and cancellations are governed by our Refund Policy. We may cancel or reschedule any class due to weather, safety concerns, low enrollment, instructor availability, or other circumstances; in that case you may reschedule or receive a full refund of the price paid.

5. Assumption of risk

Training in preparedness, wilderness, survival, safety, and firearms activities involves inherent risks — including strenuous physical activity, weather exposure, uneven terrain, tools, fire, edged implements, and firearms. Injury, illness, property damage, or death are possible. By registering, you knowingly and voluntarily assume all such risks on behalf of yourself and each student you register, whether or not caused by our negligence.

6. Release and limitation of liability

To the fullest extent permitted by law, you release, waive, and discharge Carolina Preparedness, its owners, instructors, contractors, and affiliates from any and all claims, demands, damages, or causes of action arising out of or related to your participation in the Services, except for claims arising from gross negligence or willful misconduct.

Our aggregate liability to you for any claim relating to the Services will not exceed the amount you paid us for the class or service giving rise to the claim. We will not be liable for indirect, incidental, consequential, special, or punitive damages, or lost profits.

A separate written waiver, release, and assumption-of-risk document must be signed on class day for every participant. If you do not sign, you may not participate and no refund will be issued.

7. Participant conduct

• Follow all instructor directions and safety briefings at all times.
• Do not participate while impaired by alcohol, drugs, or medication that affects safety.
• Wear appropriate clothing, footwear, and safety equipment as listed for the class.
• Disclose relevant medical conditions, allergies, or limitations before class begins.
• Respect other participants, private property, and range/site rules.

We may remove any participant who violates these rules or presents a safety risk, without refund.

8. Firearms training

You represent that you are legally allowed to possess and use firearms and ammunition under federal, state, and local law, and that you are not prohibited from doing so for any reason (including but not limited to a felony conviction, domestic-violence restraining order, or dishonorable discharge). Only firearms and ammunition permitted by the instructor and range may be used. Instructors have final authority on the range and may end participation at any time for safety reasons.

9. Not professional advice

Our classes and content are educational only. They are not medical, legal, tactical, or emergency advice, and should not be relied on as a substitute for professional judgment or emergency services. Always call 911 for emergencies.

10. Photos and media

We may take photos or video during classes for training, quality assurance, and marketing. Let the instructor know before class if you do not want to appear in publicly shared media, and we will accommodate reasonable requests.

11. Intellectual property

All Site content, course materials, curricula, logos, and branding are owned by Carolina Preparedness or our licensors and are protected by law. You may not copy, distribute, or create derivative works without our written permission, except for personal, non-commercial use of materials you receive as a student.

12. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

13. Third-party services

The Site relies on third-party services (payment processing, email, hosting, mapping). We are not responsible for their availability, content, or actions.

14. Disclaimers

The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless Carolina Preparedness and its instructors, contractors, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

16. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of- laws rules. Any dispute will be brought exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction and venue.

17. Changes to these terms

We may update these Terms from time to time. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
